DUI Deferred Prosecution

A deferred prosecution may be your best chance to stay out of jail and avoid a license suspension. A deferred prosecution requires enrollment in a counseling and treatment program for alcohol addiction for a period of two years. This program offers the following benefits to those who qualify:

  • No jail time will be imposed
  • No DUI conviction will be recorded on your driving record
  • No requirement to file high-risk insurance

In most cases, a petitioner for a deferred prosecution must satisfy the following requirements:

  • He or she is an alcoholic
  • He or she requires treatment
  • Repeat DUIs are likely unless treatment is given
  • He or she has never been granted a deferred prosecution before

If you meet the requirements of this program, we will work to find the right treatment agency for you and to help assure your success in the program. Treatment is not right for everyone, but for those who are committed to participating in treatment and pursuing a deferred prosecution, it is possible to avoid both going to jail and having a license suspension.

As an additional service to our clients, our fees include complete representation during the full five years of the deferred prosecution, up to the time that the court dismisses the charges and closes the file.
